Autovert Technologies Private Limited and its affiliates (collectively “Ecozaar”, “Company”, “we”, “our”, “us”) understand and recognize your right to confidentiality and are committed to protecting and preserving your privacy. This privacy policy forms an integral part of the User Terms. Subject to the provisions of this Privacy Policy and applicable law, the Company may collect, receive, store, deal in, handle and share your Data when you use www.ecozaar.in, and its m-site (hereinafter referred to as the “Platform”).

While you can access or browse sections/parts of the Platform without the need of sharing any Personal Information with us, however, please note any product or service offered on this Platform (a) can only be purchased when you are registered with the Platform and (b) are not offered to Users outside India or cannot be availed by Users outside India and (c) your Personal Information will primarily be stored and processed in India.

Consent

By visiting or accessing or using this Platform, providing your Personal Information or availing any product/service listed on the Platform or listing your product/service on the Platform, you expressly agree to be bound by the terms and conditions of this Privacy Policy, and agree to be governed by the laws of India including but not limited to the laws applicable to data protection and privacy. If you do not agree please do not use, visit or access our Platform.

You, while providing your Personal Information over the Platform or any partner platforms or establishments, consent to us (including our other corporate entities, affiliates, lending partners, technology partners, marketing channels, business partners and other third parties like credit bureaus ) to contact you through SMS, instant messaging apps, call and/or e-mail for the purposes specified in this Privacy Policy.

Children Information

Use of our Platform is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. We do not knowingly solicit or collect Data from children under the age of 18 years. If you are under the age of 18 years, you may use the Platform only under the supervision of your parent or guardian. If we become aware that a person submitting Data is under the age of 18 years, we will delete the account and any related information as soon as possible.

Definitions

For the purposes of this Privacy Policy,

(a) “Data” shall include any non-personal information, Personal Information and Sensitive Personal Information about you, which either directly or indirectly in combination with other information, could allow you to be identified when you visit our Platform.

(b) “Force Majeure Event” shall mean any event that is beyond our reasonable control and shall include, without limitation, sabotage, fire, flood, explosion, act of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to your mobile or storage device, crashes, breach of security and encryption.

(c) “Partner(s)” shall mean select third parties (including affiliates of the Company), at set out in [Company to provide link of the third parties], with whom we have contracts for the businesses described in this Privacy Policy.

(d) “Personal Information” means any information relating to the Users which, either directly or indirectly, in combination with other information available or likely to be available with the Company, is capable of identifying such Users and includes Sensitive Personal Data (as defined below) of the User.

(e)“Sensitive Personal Data” in relation to a User means personal data or information of a User which consists of information relating to:-

(i) password;

(ii) financial information such as bank account or credit card or debit card or other payment instrument details;

(iii) physical, physiological and mental health condition;

(iv) sexual orientation;

(v) medical records and history;

(vi) biometric information;

(vii) any detail relating to the above clauses as provided to the Company for providing service; and

(viii) any information received under the above clauses by the Company for processing, or stored or processed under lawful contract or otherwise:

provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as Sensitive Personal Data or Personal Information for the purposes of this Privacy Policy.

(f) “Service Providers” shall include entities to whom we or other affiliates may disclose your Data in order to process information for a specific purpose pursuant to written contract.

(g) “Third Party” shall mean any person or entity other than you or us.

(h) ”User” or “you” shall mean the natural person who accesses our Platform.

Collection of Your Data

When you use our Platform, we collect and store your Data for various purposes set out in this Privacy Policy.

This Data may include, without limitation, the following categories:

Sharing of Personal Data

Contact information: first and last name, email address, postal address, country, employer, phone number and other similar contact data;

Financial information: payment instrument information, transactions, transaction history, preferences, method, mode and manner of payment, spending pattern or trends, and other similar data, bank account information if you are registering to be a seller on the Platform, permanent account number if you are registering to be a seller on the Platform, goods and services registration number if you are registering to be a seller on the Platform;

Technical information: website, device usage, Internet Protocol (IP) address and similar information collected via automated means, such as cookies, pixels and similar technologies;

Transaction information: the date of the transaction, total amount, transaction history and preferences and related details;

Product and service information: Your account membership number, registration and payment information, and when you request products and/or services directly from us, or participate in marketing programs;

Personal data: Age, sex, date of birth, marital status, nationality, details of government identification documents provided, thumb impression, occupation, or any other information provided in product reviews or responses to surveys or questionnaires;

Your reviews, feedback and opinions about our products, programmes and services;

If you are a Subscriber (as defined in the EV Subscription Terms (displayed and available on the Platform)), then we collect Information (as defined in the EV Subscription Terms) in the manner specified in the EV Subscription Terms

which is provided by you from time to time. Once you give us your Personal Information, you are not anonymous to us. Where possible, we indicate which fields are required and which fields are optional. You always have the option to not provide Data by choosing not to use (a) a particular service, product or feature on the Platform or (b) our Platform.

Data collection process

We may collect Personal Information (such as Contact information (i.e. email address, password, delivery address, name, phone number) from you when you (i) set up an account or (ii) transact with us (i.e., avail any services or purchase any products on our Platform) or (iii) participate in any event or contest or (iv) complete any surveys or (v) comment on any online content published on the Platform or (vi) when you elect to receive any communications (including promotional offers) from us. While you can browse some sections of our Platform without being a registered member, certain activities (such as placing an order or commenting on our online content or other services) do require registration.
You can also register to become a registered User by logging into online accounts you may have with Third Party service providers (“SNS”) (e.g. Facebook or Google); each such account, a “Third Party Account”. As part of the functionality of the Platform, you may link your account with Third Party Account, by either: (a) providing your Third Party Account login information to us through the Platform; or (b) allowing us to access your Third Party Account, as is permitted under the applicable terms and conditions that govern your use of such Third Party Account. If you decide to register by logging into a Third Party Account via the Platform, we will obtain the Personal Information you have provided to such Third Party (such as your first and last name, email address, profile picture, other information you make publicly available via the applicable SNS and/or other information you authorize us to access by authorizing the SNS to provide such information) from your Third Party Account and use that Data to create your account and profile page and you will become a registered User. Depending on the Third Party Account you choose and subject to the privacy settings that you have set in such Third Party Account, you understand that by granting us access to the Third Party Account, we will access, make available and store the information in your Third Party Account so that it is available on and through your account on the Platform.
We will also collect your information related to your transactions on our Platform and such third-party business partner platforms. When such a third-party business partner collects your Data directly from you, you will be governed by their privacy policies. The Company shall not be responsible for the third-party business partner’s privacy practices or the content of their privacy policies, and we request you to read their privacy policies prior to disclosing any information or Data.
If you choose to post messages on our message boards, chat rooms or other message areas or leave feedback on the Platform or the social media handles maintained by us and certain features to shop on the Platform, we will collect that information you provide to us. We retain this information as necessary to resolve disputes, provide customer support, troubleshoot problems or for internal research and analysis as permitted by law.
We may track your buying behavior, preferences, and other information that you choose to provide us on our Platform. We use this information to do internal research on our users’ demographics, interests, and behavior to better understand, protect and serve our Users. This information is compiled and analyzed on an aggregated basis. This information may include the URL that you just came from (whether this URL is on our Platform or not), which URL you next go to (whether this URL is on our Platform or not), your computer browser information, and your IP address.
If you send us personal correspondence, such as emails or letters, or if other Users or third parties send us correspondence about your activities or postings on the Platform, we may collect such information into a file specific to you.
We may collect your Data automatically via Cookies, pixels and similar technologies in line with settings on your browser.

Usage of Data

The Data collected from you and about you is used for the following purposes:

Purchase/Sale of products: We use your Personal Information to take orders, to assist sellers and business partners in handling and fulfilling orders, deliver products and services, processing payments, and communicate with you about orders, products and services, and promotional offers.
Troubleshoot/improve the Platform: To provide, troubleshoot, and improve the Platform. We use your Personal Information to provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of the Platform.
Recommendations and personalization: We use your Personal Information to recommend features, products, and services that might be of interest to you, identify your preferences, and personalize your experience with the Platform. We may also share your preferences with your network followers on the Company for marketing and other promotional activities of our Platform.
Legal Obligations: In certain cases, we collect and use your Personal Information to comply with Indian laws. For instance, we collect from sellers, information regarding place of establishment and bank account information for identity verification and other purposes.
Communications: We use your Personal Information to communicate with you in relation to the Platform or the products offered on the Platform via different channels (e.g., by phone, e-mail, chat).
Marketing: We use your Personal Information to display interest-based ads for features, products, and services that might be of interest to you. We do not use Data that personally identifies you to display interest-based ads.
Fraud Prevention and Credit Risks. We use Personal Information to prevent and detect possibility of non-payment, fraud, and abuse in order to protect the security of our users, the Company, and others. We may also, directly or through a third party (including CICs), use scoring methods to assess and manage credit risks, including by way of sharing the result of said scoring methods with relevant third parties, payment gateways, financial institutions.
Research: We may use your Data to generate and review reports and data, and to conduct research on the Company’s user base and service usage patterns and to conduct research following internal review protocols to ensure the balancing of privacy and to use anonymized data for research.
We may use your Data to carry out Company’s obligations and enforcing rights arising from any contracts entered into between you and the Company, including for billing and collection.
We may use your Data to fulfil any other purpose for which you provide us the Data and/or for any other purpose with your consent.
We may use your Data to check your eligibility for certain products/services including but not limited to credit and payment products and provide access to the services being offered by our affiliates, banks, financial institutions or our lending partners.

Sharing of personal data

We may share the Data you share with us, in the following ways:

We may share the Data, internally within the group companies, which are entities under common ownership or control of the Company, for purposes of providing products and services offered by them. These entities and affiliates may share such information with their affiliates, business Partners and other third parties for the purpose of conducting the required checks, namely for the purpose of credit underwriting, providing you their products and services and may market to you as a result of such sharing unless you explicitly opt-out.
We may disclose your Data to third parties, such as sellers, business Partners. This disclosure may be required for us to provide you access to our products and services; for fulfillment of your orders; for enhancing your experience; for providing feedback on products; to collect payments from you; to comply with our legal obligations; to conduct market research or surveys; to enforce User Terms; to facilitate our marketing and advertising activities; to analyze data; for customer service assistance; to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our product and services.
We may disclose Data if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose Data to law enforcement agencies, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to enforce our Terms of Use or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public.
We and our affiliates will share / sell some or all of your Data with another business entity should we (or our assets) plan to merge with, or be acquired by that business entity, or reorganization, amalgamation, restructuring of business. Should such a transaction occur that another business entity (or the new combined entity) will be required to follow this Privacy Policy with respect to your Data.

Cookies

Cookies are small files in the nature of alphanumeric identifiers which are placed on your hard drive that assist us in providing our services. Certain features of the Platform are only available through the use of a “cookie”. Cookies are also used by us to (a) allow you to enter your password less frequently during a session and (b) help us provide information that is targeted to your interests. Most cookies are “session cookies,” which are deleted from your hard drive at the end of a session. You are always free to decline/delete our cookies if your browser permits, in which case certain features on the Platform will not be available to you and you may be required to re-enter your password more frequently during a session. Additionally, you may encounter “cookies” or other similar devices on certain pages of the Platform that are placed by third parties. We do not control the use of cookies by third parties. We encourage you to read the privacy policies of all external sites/third parties. We also use cookies from third party partners for marketing and promotional purposes.

Links to Other Sites

Our Platform may provide links to other websites or applications that may collect Data about you and you will be governed by their privacy policies. The Company shall not be responsible for the privacy practices or the content of their privacy policies, and we request you to read their privacy policies prior to disclosing any information.

Security Precautions

We maintain reasonable physical, electronic and procedural safeguards to protect your Data and store your Data on secure servers. Whenever you access your account information, we offer the use of a secure server. Once your information is in our possession, we adhere to our security guidelines to protect it against unauthorized access. However, by using the Platform, the users accept the inherent security implications of data transmission over the internet and the World Wide Web which cannot always be guaranteed as completely secure, and therefore, there would always remain certain inherent risks regarding use of the Platform. Users are responsible for ensuring the protection of login and password records for their account. If you suspect any misuse or loss or unauthorized access to your Data, please let us know immediately by contacting us by e-mail support@ecozaar.com.

Notwithstanding anything contained in this Privacy Policy or elsewhere, the Company shall not be held responsible for any loss, damage or misuse of the Data, if such loss, damage or misuse is attributable to a Force Majeure Event.

Choice/Opt-Out

We provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications after setting up an account with us. If you do not wish to receive promotional communications from us, then please write to support@ecozaar.in.

Advertisements on Platform

We use third-party advertising companies to serve ads when you visit our Platform. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide personalized advertisements about goods and services of interest to you.

Data Retention

We retain your Data in accordance with applicable laws, for a period no longer than is required for the purpose for which it was collected or as required under any applicable law. However, we may retain Data related to you if we believe it may be necessary to prevent fraud or future abuse, to enable us to exercise its legal rights and/or defend against legal claims or if required by law or We may continue to retain your data in anonymised form for analytical and research purposes.

EV Subscription Terms

Your Rights

We take every reasonable step to ensure that your Data that we process is accurate and, where necessary, kept up to date, and any of your Data that we process that you inform us is inaccurate (having regard to the purposes for which they are processed) is erased or rectified. You may access, correct, and update your personal data directly through the functionalities provided on the Platform. You may delete certain non-mandatory information by logging into our Platform and visiting Profile and Settings sections. You can also write to us at the contact information provided below to assist you with these requests.

You have an option to withdraw your consent that you have already provided by writing to us at the contact information provided below. Please mention “for withdrawal of consent” in the subject line of your communication. We will verify such requests before acting upon your request. Please note, however, that withdrawal of consent will not be retroactive and will be in accordance with the terms of this Privacy Policy, related Terms of Use and applicable laws. In the event you withdraw consent given to us under this Privacy Policy, such withdrawal may hamper your access to the Platform or restrict provision of our services to you for which we consider that information to be necessary.
